Trademark Registration

Rights in relation to a trademark may be established through registration or are protected from unauthorized use through registration or through actual use if the goods or services occupy a highly significant position in the marketplace or gained notoriety. While it can be very difficult to prove the latter two during litigation, with a registered trademark the owner’s rights become apparent instantly.
The region for which protection is sought determines the handling. If the trademark owner is predominantly interested in offering the goods and services in Germany, we will file the trademark application at the Deutschen Patent- und Markenamt (DPMA) in Munich. If the area in which trademark protection is sought is larger and comprised of other European countries, the application at the Office of Harmonization for the Internal Market (OHIM) in Alicante is advisable. Even though the fees are higher and the time expenditure is higher, protection for all European countries is available.

Of course, most other countries in the world have their own trademark agencies. There, you can apply for trademark protection as well, but you will need a local representative from this country. Another possibility is the application for an international trademark through WIPO (World Intellectual Property Organization). This is the trademark registration under the Madrid Agreement and Madrid Protocol and grants protection in many countries by filing a single trademark registration request, based on a single application or registration in one of the member states.
